This year, we celebrate fifty years of one of the most critical conservation laws in the United States. On December 28th, 1973 the Endangered Species Act (ESA) was passed by Congress. The ESA has prevented 99% of all fish, wildlife, and plants under its protection from going extinct – an incredible feat. Scientists estimate more than 200 at risk species would have gone extinct if not for the development of the ESA. The ESA provides a legal framework to conserve and protect listed species and has safeguarded the biodiversity across the nation, supported the recovery of imperiled species, and conserved the critical habitats they depend on.
Currently there are over 1,600 endangered and threatened species listed under the ESA in the United States. Once a species is listed, a full range of protections available under the ESA goes into effect, including prohibitions on killing, harming, or otherwise “taking” a species. The ESA is fundamental to our work at Conserve Wildlife Foundation of New Jersey and has allowed us to be better ambassadors for New Jersey’s threatened and endangered wildlife.
When CWF began monitoring American oystercatchers nesting on the Delaware Bay this past spring, we also set out to place field-readable bands on as many oystercatcher adults and chicks as logistically possible. Band resights allow biologists to collect a wealth of information about site fidelity, habitat use, dispersal, and migration, especially when data is collected over many years. Since the Delaware Bay population of oystercatchers was previously unmonitored, we have a lot to learn about their life histories and how they may differ from other oystercatchers in the state, if at all. Where are these birds staging and wintering? Do breeding adults return to the same mates and nesting locations each year? Where do fledged chicks disperse, and will they return to their natal grounds on the Delaware Bay to breed upon reaching sexual maturity? Banding efforts, combined with resight data reported by biologists, dedicated volunteers, and the general public will help answer these questions (and more) as we increase the number of marked individuals on the Bayshore.
This year was an especially challenging one for beach nesting birds in New Jersey. Most of the species fared poorly on a statewide basis, and even though they can withstand periodic down years, several trends are worrisome to biologists and wildlife managers.
The state’s piping plover breeding population remained the same as last year with 118 pairs, which is also about the same as the long-term average since federal listing. However, productivity was just 0.53 chicks fledged per pair, the second lowest since federal listing and well below the levels believed necessary to grow the population. Of particular concern, productivity has been low for three consecutive years after a number of years of above average success. Productivity is one of the main drivers of population (up or down) and small populations are especially sensitive to even small changes, so it is expected that the population is likely to drop over the next few years, further stagnating plover recovery in the state.
Meanwhile, there was a record number (53) of breeding pairs of piping plovers at Holgate, a unit of the Edwin B. Forsythe National Wildlife Refuge, that is monitored by CWF through a cooperative agreement with the Refuge. This positive trend, almost a four-fold increase has occurred since Superstorm Sandy enhanced the habitat for plovers at the site, has been an ongoing highlight for the state in recent years. Nonetheless, it has not been accompanied by similar increases elsewhere in the state, so it has not led to any statewide recovery. Productivity for the large concentration of piping plovers at Holgate was above the statewide average in 2023 but the lowest level over the past decade, so it was also a down year for this site, where expectations typically run high that it will help boost statewide productivity.
The Three Bridges eagle cam went live for the 2024 nesting season on December 1st. A pair of eagles made an appearance that morning. The Three Bridges nesting platform was used by eagles in 2021, when they successfully raised two young. During the 2022 and 2023 nesting seasons, the pair were seen at the nest platform but ended up using a nest in a tree. We will see if the pair decides to use the nest platform this season. For now we believe that the Three Bridges pairs territory is both the nest tree and platform. As the numbers of nesting Bald Eagles continues to increase New Jersey there is the possibility that a second eagle pair could nest at the platform. Last nesting season there was lots of eagle action at the tower, eagles of all ages stopped by along with many different avian species. A pair of Osprey’s took interest in the nest platform but didn’t end up laying eggs. An American Kestrel perched at the platform on the first day the cam was live. It’ll be interesting to see what activity occurs at the tower this season.
We always go out of our way to help provide ospreys with safe, suitable nest sites. This has been our mission since we began working with them over 15 years ago and has helped the population surpass the historic population estimate of over 500 nesting pairs. Our loyal New Jersey Osprey Project volunteers follow this same principal — always on the lookout for damaged nest platforms — to take meaningful action.
This marked the second year that CWF worked in close partnership with New Jersey Fish and Wildlife and Edwin B. Forsythe National Wildlife Refuge (EBF) to monitor and manage birds on Horseshoe Island. The island, located just offshore on the southern edge of the Little Egg Inlet, has quickly become one of the most important sites for beach nesting birds in the state, as well as a critical resting and feeding site for migratory shorebirds.
Horseshoe Island hosted the state’s largest black skimmer (state endangered) colony this year with just over 1400 total adults or about 700 pairs. Although flooding and some avian predators impacted the overall nesting success at the island, at least 225 skimmer chicks “fledged” from the site. Horseshoe’s skimmer fledglings, along with those from nearby Holgate, a unit of EBF, and especially from Stone Harbor Point in Cape May County, made 2023 a moderately good productivity year for black skimmers in New Jersey.
Etiquette tells us that we shouldn’t have a favorite child. I sometimes wonder if the same rules apply to biologists with regard to our study species. If so, my manners fall woefully short, at least where reptiles are concerned.
Conserve Wildlife Foundation has been partnering with the United States Fish and Wildlife Service (USFWS) on bog turtle conservation initiatives for years. We do this using a multi-faceted approach. We connect landowners with qualifying habitat with federal funding opportunities and technical support that can preserve and restore significant wetlands. We assist the state and nonprofit partners with visual surveys to better understand the status of historic populations. Finally, we suit up with USFWS personnel each fall and winter to remove invasive species and woody vegetation that are shading out nesting spots, rendering bogs and fens inhospitable to turtles. We applied to continue this work for the next few years but decided to shake things up a bit by adding in tasks targeting the protection of the bog turtle’s closest living relative… the wood turtle, a state threatened species that is currently under consideration for federal listing.
Last week I attended the APLIC (Avian Powerline Interaction Committee) workshop hosted by PSE&G. APLIC is a group that leads the electric utility industry in protecting avian resources while enhancing reliable energy delivery. We all use electricity and power lines are needed to distribute the power to where it’s needed. Powerlines and transmission towers have become a normal part of the landscape and we don’t pay much attention until our power goes out. All different species of birds, from bald eagles to starlings, interact with powerlines, poles and towers daily, including perching and nesting on them.
With these interactions come issues, birds can be injured or die from electrocution and collisions which can cause power outages. Nests on poles and transmission towers can create problems with outages and fires as well as risk to chicks or adults. One part of my job is keep track of all reported injured or dead bald eagles in New Jersey. In 2023 there have been fifteen confirmed eagle electrocutions. Any recoveries that are a suspected electrocution or collision with a powerline are reported to the appropriate utility company. CWF and the NJ ENSP have a good relationship with the Utility companies in New Jersey. Each utility company has biologists that work on environmental issues including avian. There are a whole set of issues that they need to be taken into consideration when deciding how best to minimize negative avian interactions. The solutions require time, money and often scheduled power outages. When an area of lines or poles are identified as a risk for bird electrocution/collision, they are made as avian safe as possible. When new distribution lines are rebuilt, avian issues are taken into consideration and the appropriate measures are implemented.
There are quite a few bald eagles and ospreys that nest on poles and transmission towers throughout New Jersey. Most of these nests don’t cause problems, but if they need to be removed, the utility company works to obtain the proper permits and replace the nest with a new nesting structure in close vicinity. One example is the Three Bridges eagle nest. PSE&G needed to replace the entire distribution line where an eagle pair had been nesting on one of the towers for years. After much planning and coordination the nest was removed and placed on a nest platform installed on one of the new towers.
I certainly learned a lot at the workshop and gained a new appreciation for everything that goes into keeping our electricity flowing at the flick of a switch and making sure that avian species stay safe at the same time.
Internationally celebrated, Bat Week runs from October 24th through October 31st. This week we celebrate bats to raise awareness for these nocturnal creatures that are often left in the dark. In New Jersey, we have two federally listed bat species, the Indiana bat and the Northern long-eared bat. Several more bats are being uplisted to the threatened and endangered list. Threats primarily include habitat loss and a fungal disease called white-nose syndrome.

Each year since 2017, CWF has been teaming up with partners from the USFWS New Jersey Field Office to survey the JB McGuire Airfield for grassland birds during the breeding season. Part of a long-term monitoring project, the airfield has been undergoing habitat restoration to maintain native warm season grassland habitat. The habitat restoration efforts are nearly 70% complete with roughly 700 acres seeded since 2017 and another 100 acres to be completed the following year.
Six of the ground-nesting bird species documented at the airfield are State-listed as either endangered, threatened, or of special concern. The eastern meadowlark (Sternella magna), a member of the blackbird family, is a State Species of Concern. It prefers a minimum of ten to twenty acres of unfragmented dense grasses of medium height for nesting. The State-threatened grasshopper sparrow (Ammodramus savannarum) favors patches over 100 acres containing short- to medium-height bunch grasses interspersed with patches of bare ground, a shallow litter layer and scattered forbs. The savannah sparrow (Passerculus sandwichensis), also State-threatened, requires a mix of short and tall grasses, a thick litter layer, dense ground vegetation, and scattered forbs. Another member of the blackbird family is the State-threatened bobolink (Dolichonyx oryzivorus). Bobolinks prefer to place their nests in areas of greatest vegetative height and density and could potentially nest in patches as small as five to ten acres. The State-threatened horned lark (Erimophila alpestrias) nests in areas of barren ground with short and sparse cover and are quick to abandon sites as vegetation grows thicker.
